FOSTER CHILD OR YOUTH
ACCORDING TO EC 48853.5(A), A CHILD OR YOUTH WHO:
- Has been removed from their home pursuant to WIC 309 (temporary custody);
- Is the subject or a petition filed under WIC 300 (alleging abuse or neglect of the child) or WIC 602 (alleging the youth violated the law), whether or not the child has been removed from their home;
- Is a dependent child of the court of an Indian tribe, consortium of tribes, or tribal organization who is the subject of a petition filed in the tribal court pursuant to the tribal court's jurisdiction in accordance with the tribe's law; or
- Is the subject of a voluntary placement agreement.
- A youth between the ages 18 and 21 who is enrolled in high school, is a non-minor dependent under the placement responsibility of child welfare, probation, or a tribal organization participating in an agreement pursuant to WIC 10553.1 and is participating in a transitional independent living case plan.
